Not everything that can be counted counts, and not everything that counts can be counted

William Bruce Cameron

Commercial disputes often require the calculation of the amount required to put the plaintiff in the position it would have been had the alleged wrong not been committed (i.e. looking back) or if the contract between the parties had been performed in accordance with its terms (i.e. looking forward).

Other calculations of economic loss could be required where there is a breach of trust or fiduciary duty or breaches of Corporations law.

Thorough contemplation of all the issues involved is required to try and estimate the difference between cash flows that would have occurred and those that did.

It may be necessary to apply interest from the date of breach or to apply an adjustment for tax.

Reconstruction of trading and profitability either past or looking forward to future periods is a service Experience Counts® has provided.
